An order, imperative direction, or behest. State v. Mann, 2 N.C. 4; Barney v. Hayes, 11 Mont. 571, 29 P. 282, 28 Am.St.Rep. 495. As applied to a fortress, “command” means actual control of the garrison for military purposes. As applied to a ship, it means actual control of the crew for nautical purposes. Hamilton v. U. S., C. C.A.Va., 268 F. 15, 19.
The term “instance,” as used with reference to doing an act at one’s instance, does not imply the same degree of obligation to obey as does “command.” Feore v. Trammel, 104 So. 808, 813, 213 Ala. 293.
